Field Sobriety Testing

Field Sobriety Testing DUI Defense Attorney in Newark

If you are pulled over by law enforcement and charged with DUI, there is a lot you can do to protect your freedom and your license to drive.

If you are pulled over for suspicious driving, a police officer often performs Field Sobriety Tests to determine if you driving under the influence of drugs or alcohol.

The National Highway Traffic and Safety Administration has created standardized Field Sobriety Tests designed to test coordination and agility, such as divided attention and the horizontal gaze nystagmus or HGN. If the motorist is disabled, a police office may do alterative testing.

Call an experienced DUI defense attorney to question improperly administered Field Sobriety Tests. Your freedom and your driver's license may depend on it.

I am Francis E. Farren, attorney at the Law Offices of Francis E. Farren in Newark, New Jersey. I have more than 20 years of experience defending clients charged with DUI and traffic violations. To set up your free consultation, contact me by email or call me at 866-603-4647 or 302-294-0331.

Building a Strong DUI Defense

A Non-Standardized Field Sobriety Test may be administered by a police officer if he or she suspects you are driving under the influence of drugs or alcohol. These may include:

  • Reciting numbers of the alphabet backwards
  • Placing your finger on your nose while your eyes are closed
  • Testing your balance
  • Counting the number of fingers held up by the testing officer

All of these Field Sobriety Tests — standardized and non-standardized alike — test physical dexterity and may be called into question by me as your criminal defense attorney.

As an experienced DUI defense lawyer, I look at conditions which could make accurate testing difficult, including glare from the police officer's cruiser or headlights, confusing instructions and bad weather conditions like rain, snow or fog.

You may be wearing high heels, which almost guarantees you will fail the Field Sobriety Tests. Maybe it was late and you were fatigued, or maybe you just aren't terribly coordinated. Even age and weight can lead to false conclusions.

When I take your DUI defense case, I will do whatever it takes to protect your rights. Call me as soon as possible at 866-603-4647 or 302-294-0331. Or contact my office via email to schedule a free initial consultation.
